Having a good Last Will and Testament is the best way to ensure that your estate is handled in accordance with your wishes.   Wills become legally enforceable when they are admitted to “Probate”.  In Texas we have the option of having an “Independent Administration” of the Estate.  This simplifies the probate process and allows the Executor to settle the estate without having to get approval from the Probate Court.  A well written will should appoint an executor to serve without bond, provide for an Independent Administration and include a self-proving affidavit to streamline the probate process.
